1. Introduction
In this text, the term "we" means CarmediaStore - Axterisko Informatica Snc and "you" means yourself, that is the customer. These terms and conditions herein, together with your Order Confirmation constitute the Contract between us and you for the supply of Products. No other terms and conditions shall be applicable. The Contract can not be changed except by prior written agreement by e-mail.
2. Place Order
2.1 To place an order you must be an adult and be reachable by phone (not through mobile phones).
2.2 It's possible to place an Order in the following ways:
2.2.1 filling the order form available at CarmediaStore.com, after you have registered and created your personal account, and pressing the "Checkout" button;
2.2.2 By phone between 09.00 am and 06.00 pm Monday to Friday.
We will not accept orders in any way other than those listed above:
2.3 When you make an order, we assign an order number, unless the order is made by telephone, in which case, your Web Order Number will be given you by phone or email.
2.4 By placing an Order, you make an offer to purchase the items selected on the basis of these terms and conditions . We may or may not accept the proposal.
2.5 If the order is accepted, we will give notice of acceptance by issuing an Order Confirmation by e-mail. The Order Confirmation will be effective on sending. If the Order will not to be accepted, we will contact you by e-mail or telephone.
2.6 We'll do our best to effect delivery the Products listed on the Order Confirmation, but may be that we are not able to supply these Products because, for example, these products are no longer being manufactured or because we are not able to source the right components, or could happen that the order is invalid because of a clerical error in the prices indication on CarmediaStore.com . In the event that any one of the assumptions above, we will contact you to inform and suggest alternative products that you should buy. In the event that tou prefer not to accept our proposals your order will be cancelled and we will refund the total amount paid in relation to your order. In the event that we fail to be able to deliver products ordered by you, our liability will not exceed the return in your favor of the amounts paid by you.
2.7 The information contained in our advertising, brochures and other promotional materials, on our web sites or given to you by our agents or employees constitutes an invitation to treat. No such information may be considered as an offer to supply products.
3. Product Supply
The supply of the Products indicated on your Order Confirmation will be made together with the following Terms and Conditions.
4. Prices
4.1 The price of products will be the one indicated on your Invoice.
4.2 VAT is payable at the rate indicated in the Invoice.
4.3 The cost of the delivery, if applicable, will be indicated in the Invoice.
5. Paying for your Products
5.1 You can pay the products by the methods listed in the payment section of CarmediaStore.com
5.2 Payments must be made in legal currency as indicated in the Invoice.
5.3 If you are paying by credit card, you must take care to indicate all the information required by the credit card. The charge will be made by the banking system selected at the time of confirmation. We will not start the manufacture and supply of the Products and the provision of services until your credit card issuer has authorized the use for payment of products ordered. We will inform tou of any failure to receive such authorization. The bill on the credit card must be located in EU. We reserve the right to verify the identity of the c credit card owner by requesting appropriate documentation.
5.4 If you are paying by wire transfer you will receive the request for payment and the bank coordinates via email in the order confirmation. The manufacture and supply of the Products and the provision of services will happen once that your payment is cleared. If we do not receive payment in cleared funds within thirty days, your Order will be canceled.
6. Products Delivery
6.1 The delivery of the Products shall be done to any address inside and outside the Italian Republic, in the Countries listed in the registration form
6.2 The delivery of products will be made to the address shown on your Order Form.
6.3. Any date for products delivery that we released must be considered non-essential and still in our favor, and does not determine our constitutional delay. If you have ordered several Products at one time, we may deliver such Products on different days. You can cancel your order within 11.00 am of the day when the order is placed, or the next day for orders placed after this time, and anyway before products shipment calling +39 011-9063161. Delivery times for Services will be agreed directly between you and us. In the event you fail to comply with the agreed date or does not have the necessary infrastructure, although at the time of appointment setting you have the certificate of availability of those resources, there will be no further obligation on our part to provide the Services purchased by you .
6.4 Ownership and risk of your Products will pass to you upon our delivery of the Products.
6.5 Upon products delivery to our carrier we will send you a shipment confirmation by e-mail. Anyway, the packing list is proof of delivery to the carrier.
7. Return and Refund Policy
7.1 If you are not satisfied with any Product or services purchased from us, you can return the Products or not use services and receive a refund of the price of returned Product or Services which have not benefited. To do this you must contact us within 10 days after delivery of the Products or within 10 days after the purchase of the Services. However, you can not return a Product and claim a refund if the Product concerned is Software which we provide sealed and you have broken the seal. You can not get a refund of the Services if you have just used them.
7.2 In order to return a Product or a Service you are not satisfied with, you have to inform us writing by fax at +39 011-9019436 or by email at servizioclienti@carmediastore.com from 09.00am to 06.00pm, Monday to Friday, to make arrangements for the return. You must return the products in their original packaging and the products must not be damaged. Upon delivery, you should have documentation from the carrier and a signed copy of transport must be kept by you.
7.3 If returned Products are not damaged, we will refund the price paid for such Products.

The products purchased between 14 and 31 December can be returned until the 10th day of January 's next year
8. Warranty
For all products we provide a guarantee that it is governed by the WARRANTY TERMS AND CONDITIONS
If you want call us in relation to the guarantee, you can do from 09:00am to 06:00 pm on any Business Day, indicating the serial number of your product. The cost of telephone calls will be at your expense, in accordance with your national rate.
9. Our Responsibility
9.1 If you are a Consumer, the provisions of this Contract cannot limit or exclude our liability for violations of the law.
If, however,you are not a Consumer:
9.1.1. these terms and conditions represent the full extent of our obligations and responsibilities in relation to the provision of the Products (and performance of warranty service and telephone support) and performance of services;
9.1.2. we'll not be responsible for other warranties, conditions or terms other than those expressly stated in this Agreement, and
9.1.3. any warranty, condition or other term concerning the Products or Services that may be related to the Contract or contained in the same statute, common law or otherwise (including, without limitation, any implied condition as to quality, suitability for purpose, reasonable care and skill) is hereby expressly excluded. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.
9.2 the Contract will not exclude or limit our liability for death or personal injury caused by negligence or willful misconduct.
9.3 We will not be liable , in the event of loss of income, profits, contracts, data, or any other direct or indirect damages of any kind arising out of or related to contractual or breach of contract, negligence or intentional, of any species.
9.4 The maximum liability for us under this Contract whether in contract, or tort (including gross negligence) or otherwise, shall in no case exceed the amount payd by you for Products or Services.
10. Export Control
With You agree to comply with all Export Laws. In particular, you agree (i) not to export any Product to any country in violation with Export Laws and (ii) not to export products to countries that require special government permission or license to export, without first obtaining all necessary licenses and permits. You specifically warrant that you are not a citizen or resident or domiciled in a country to which export of the Products is prohibited by any law .
11. Privacy Policy
By placing your Order, you agree that CarmediaStore can store, process and use the data contained in the Order in order to fulfill your order. Some of the information you provide to us will be passed to the companies we use for the shipment of the Products. Also, if you have requested a funding to pay for ordered products, the information you provide will be passed to companies providing finance for the purchase.
Upon your specific indication in the Order, by the submission of the same, you expressly agree that such data can be transferred from Axterisko Informatica to other companies to provide information about other products and services that may interest you. Upon specific written request, you can obtain a copy of the data that concern you in our possession. The costs will be borne by you. If the data in our possession will prove to be incorrect, we will correct them after your written request. Your data will be collected, recorded and processed by CarmediaStore, that is the data processor owner.
12. Force Majeure
We will make every effort to perform our obligations under this Agreement. We will in any case exempt from any liability for delays or failures caused by circumstances beyond our control. In case of delay, we will perform our obligations as soon as reasonably possible.
13. Applicable Law
This Agreement shall be governed by Italian law. We will try to resolve any dispute quickly and efficiently. If you are not satisfied with those efforts and want to appeal to the Judicial Authority, any dispute will be subject exclusively to the Italian jurisdiction.
14. Miscellaneous
14.1 If one of the party fails to enforce certain of its rights under this Agreement, it does not configure as a waiver of such term. It will be possible to exercise any of the rights listed above at a later time.
14.2 The invalidity or unenforceability of any provision in any contract shall not affect the validity or enforceability of the remaining contractual terms
